Violent Fight on Windward Way Leads to Arrests

San Rafael, CA – On 07/28/23, SRPD officers arrested Joselito Miguel Vasquez, a 33-year-old San Rafael resident, and Selvin Alvarado Vasquez, a 21-year-old San Rafael resident, after they were identified as the main aggressors during a physical fight that involved a large group of people on Windward Way in San Rafael.  Both suspects were booked into the Marin County Jail on charges related to the fray.

At 10:40 PM, SRPD began receiving 9-1-1 calls about a sizeable physical fight involving at least fourteen people.  Witnesses also reported that the involved people were throwing beer bottles at each other.  Officers were immediately dispatched and arrived at the scene within three minutes.

Upon arrival, officers contacted an injured male victim bleeding from the face, struck by what witnesses initially identified as a machete.  Witnesses pointed out two suspects described as being responsible for attacking the injured victim.  Officers detained Joselito Miguel Vasquez and Selvin Alvarado Vasquez without incident and continued investigating what had happened.

Officers learned that several people gathered on Windward Way and began drinking alcohol.  As time passed, several people got into a verbal argument that escalated into a physical fight.  Witnesses stated that during the argument, a group of people identified themselves as affiliated with a gang.  It was reported that two physical fights broke out in the street.  In one fight, Selvin had gotten into a physical fight with another person and kicked a victim multiple times in the face and stomach.  In the second fight, Joselito began fighting with another person and used a knife sheath to strike the victim in the face causing the laceration.  Selvin had left the first fight and joined the second fight with Joselito.  The fighting continued until just before the police arrived on the scene.

It was determined that the original report of the machete being used was actually a large sheath for a knife.  Officers are also investigating to determine if some of the people involved were, in fact, affiliated with a criminal street gang.

Officers located the knife sheath Joselito reportedly used to strike the victim and seized it as evidence.  When the sheath was found, it did not contain a knife.  Officers also observed many cases of beer and broken beer bottles in the roadway.

The San Rafael Fire Department was called to the scene and provided medical aid to the victim with the face laceration.  The victim was transported to a local hospital for the facial laceration for further treatment.  The other victim, that had been kicked in the face and stomach, was checked at the scene and did not require further medical treatment.  No other persons involved at the scene required medical attention.

Officers arrested and booked both Joselito and Selvin into the Marin County Jail.  Joselito Miguel Vasquez was charged with felony assault with a knife and was being held in lieu of $50,000 bail.  Selvin Alvarado Vasquez was charged with misdemeanor assault and battery and was being held in lieu of $2,000 bail.

Officers will continue to investigate this incident, including reviewing nearby video surveillance footage to determine if any other persons in this incident will be charged or arrested for participating in the fight.
