SRPD Quickly Arrests Man Who Fired Gun and Threatened People on Shoreline Path

San Rafael, CA – On 06/27/23, SRPD officers arrested Jose Arguello-Gutierrez, a 59-year-old San Rafael resident, after he fired a handgun and then threatened people using the Starkweather Shoreline Pathway.  The gun was recovered, and Arguello-Gutierrez was booked into the Marin County Jail on several felony charges.

Just before 1:45 PM, SRPD began receiving numerous 9-1-1 calls about a male suspect with a gun on the Starkweather Shoreline Pathway near the backside of the 2100 block of Francisco Boulevard East.  Callers told dispatchers that the suspect had fired the gun and was brandishing and threatening other people using the path.  Several callers acted as good witnesses and provided a detailed description of the suspect.

The first SRPD officers arrived within minutes and began setting up a containment perimeter around where the suspect was last seen.  Within eight minutes of establishing the perimeter, officers located the suspect hiding near a building at 2675 Francisco Boulevard East.  Officers called out to the suspect, and he cooperated with police commands.  

Arguello-Gutierrez was taken into custody without incident.  Arguello-Gutierrez was not found in possession of the gun when he was contacted but it was located where he had been hiding.  The firearm was found to be loaded when it was recovered.

During the investigation into what occurred, officers determined that Arguello-Gutierrez fired the gun one time into the air.  Officers retraced the steps where Arguello-Gutierrez was seen firing the gun and located an empty ammunition casing that matched the caliber of the found handgun.  Officers also located video surveillance showing Arguello-Gutierrez pointing the gun at the head of a bicyclist using the path.  Nobody was physically injured during the incident.

Arguello-Gutierrez, who is familiar to SRPD, was booked into the Marin County Jail on felony willful and negligent discharging of a firearm in public, felony assault with a firearm, and possession of a loaded firearm.  SRPD extends our gratitude to the callers in this case who provided detailed descriptions and the location of the suspect.
