Man Shot During Christmas Party Altercation

San Rafael, CA – On Sunday, 12/15/19, David Michael Simonini, a 71-year-old San Rafael resident, was arrested for assault with a firearm, making criminal threats, and domestic violence after a Christmas party turned violent.

At 1:30 AM, SRPD Dispatch received a 9-1-1 call stating that the caller heard what sounded like gunshots in the 100 block of C Street.  Officers responded to the area and began searching for the source of the shots.

While officers were in the area, a male victim approached an officer on the street and stated that he had been shot.  Officers saw that the victim had a single gunshot wound to the foot.  Paramedics were called to the scene and began to render medical aid.

Officers learned the victim was attending a Christmas party at a friend’s house when there was an altercation.  During the altercation, Simonini pushed a female victim to the couch and then pointed a gun at the male victim.  Simonini told the victim to leave his house and threatened to shoot him. 

The victim and his wife walked out to the front door to the porch as directed.  While on the porch, the victim told Simonini that he did not think he would shoot him.  Simonini then shot the victim in the foot.  The victim made his way to the street where he was able to flag down an officer. 

The victim was taken to the hospital where he received medical treatment for his injury and was later released.  No one else was injured during the incident.

Simonini was arrested and booked at the Marin County Jail for 245(a)(2) – Assault with a Firearm, 422 PC – Criminal Threats, and 243(e)(1)PC – Spousal Battery.  This is still an active and open investigation.
