San Rafael, CA – March 20, 2012. The investigation of a pedestrian fatality that occurred earlier this year has been completed and SRPD traffic investigators have determined that the pedestrian was at fault for the collision.
On Saturday, January 14th at 9:34 p.m. officers responded to an auto versus pedestrian collision in the intersection of Second and G Streets. Jose Enrique Gonzalez Lopez, 49, died when he was struck by a car that was traveling eastbound on Second Street. The driver, Monsie Wagner, 90, was returning home to San Rafael after a visit with family members. She was not injured and there was no indication that she had been drinking.
The department’s Major Accident Investigation Team (MAIT) conducted a thorough investigation of the scene and interviewed independent witnesses. Investigators determined that the traffic signal was green for both east and westbound Second Street and Lopez crossed against the red pedestrian light. In addition, the final toxicology reports on Lopez revealed that he had a blood alcohol level of .28% at the time of the collision.
