On 09-24-11 at approximately 4:26 PM San Rafael Police Department received a 9-1-1 call from a witness who reported seeing a man with a gun in the playground area of Pickleweed Park. The witness described the suspect and told the dispatcher he was getting into a silver vehicle. As officers were arriving, the vehicle carrying the suspect drove out of the parking lot.
Officer Chuck Tirre saw the car driving on Kerner Blvd. Ofc. Tirre with the assistance of other San Rafael Police Officers, stopped the car and detained four adult occupants. Three children, ages seven months to 3 years old were found unrestrained in the car. A loaded .40 caliber pistol was found on the front passenger seat of the car.
David Arce, age 21 of Richmond was booked into the Marin County Jail for possession of a loaded gun in a public place, possession of a loaded gun in a vehicle, child endangerment and brandishing a weapon.
Mercedes Bell, age 21 of Richmond was booked into the Marin County Jail for child endangerment. She is the mother of one of the children and was responsible for caring for the other two. The children were released to a family member.
