On Saturday October 6, 2012 at approximately 12:24 a.m. a Golden Gate Transit bus driver called 9-1-1 to report that two windows of his bus had been shot out. The driver told officers that as he was turning from Grand Avenue onto Third Street he saw a black Honda Civic on the left side of the bus. The driver said he noticed that one of the passengers had an unknown object in his hand. He heard a noise and two of the windows on the left side of the bus were shattered. The driver was able to provide a description of the car, as well at its license plate. The information was broadcast in an All Points Bulletin to officers in Marin County.
Approximately fifteen minutes after the information was broadcast to officers, a sergeant from the Marin County Sheriff’s Department saw the car on Francisco Boulevard East in San Rafael. The vehicle was stopped on Fairfax Street and two occupants were detained. Evidence linking the occupants to the crime was located inside the car and the two suspects were detained. Through further investigation it was learned that the suspects, along with two additional suspects, fired pellets from sling shots at the bus. It was also learned that they targeted pedestrians, businesses and moving vehicles from Contra Costa County to Marin County.
Kelsie Niemetz, 20, of Novato, and Pablo Benavides Cardenas, 18, of San Rafael were booked at the Marin County Jail on three counts of felony vandalism and one count of throwing an object at a vehicle. Officers located the two outstanding suspects later in the day. A 16 year old male from San Anselmo and a 16 year old male from Sausalito were cited and released to their parents.
